Welcome to LocalDesi – your one-stop platform to discover and order South Asian groceries, meals, services, Religious/ praying items, festival products, and more. These Terms of Service (“Terms”) apply to all users of the LocalDesi Platform (“you”, “your”) including customers, vendors, service providers, and delivery partners.

By accessing or using the LocalDesi website, mobile apps, or services (the “Platform”), you agree to these Terms. Please read them carefully.

1. About LocalDesi

LocalDesi is an online marketplace based in Brisbane, Australia. We connect customers with local vendors, restaurants, tiffin providers, clothing outlets, pharmacies, ayurvedic sellers,  Tiffin delivery, cleaning, cooking, tutoring, beauty, religious services, fitness, wellness, freelance,  cultural services, Short-term rental of personal/commercial vehicles and other service providers from the South Asian and broader community. Our goal is to offer authentic, culturally-relevant products and services under one roof — conveniently and locally.

Deliveries may be fulfilled:

Directly by LocalDesi’s internal delivery team,
By independent delivery partners, or
In some cases, by vendors themselves.

2. Eligibility

To use LocalDesi:

You must be at least 18 years old, or
Have permission from a legal guardian to use the Platform under supervision.

By creating an account, you confirm that all registration information is accurate and that you are legally capable of entering into a contract.

3. Your Account

You are responsible for maintaining the security of your LocalDesi account.

You agree to:
Keep your login details secure,
Notify us of unauthorised access immediately, and
Not use another user’s account without permission.

4. Orders, Payments & Pricing

When you place an order:

You are entering into a direct agreement with the vendor or service provider.
LocalDesi facilitates payment and logistics, acting as a technology and support provider.
All prices are in AUD and include GST (where applicable).
Payments are processed through secure third-party providers. You authorise us to charge your selected payment method at checkout. For vehicle rentals, you are responsible for the rental terms provided by the vendor, including driver eligibility, bond requirements, fuel policy, and liability conditions.

5. Fulfilment & Delivery

LocalDesi offers delivery through:
Our own delivery team,
Third-party partners,
Or directly by vendors, depending on availability and region.
Delivery times are estimates only and may vary due to traffic, weather, or item availability.
Some services (e.g. tiffin, on-demand household help) may involve recurring or scheduled fulfilment. You will be notified of recurring charges and can cancel in accordance with the cancellation terms.

6. Cancellations & Refunds

Cancellations and refunds may be permitted in cases including:
Vendor unavailability/ No-show service providers
Wrong or missing items,
Delay beyond a reasonable timeframe.
You must notify us within 24 hours of receiving your order for refund requests. Refunds are processed back to your original payment method, typically within 5-7 business days.
Some products (e.g. perishable goods or custom-made items) may not be eligible for return or refund unless faulty under Australian Consumer Law.

7. Vendor & Service Responsibility

Each vendor or service provider is responsible for:
The quality, safety, and legality of their offerings,
Fulfilling orders accurately and on time,
Complying with all relevant Australian standards and regulations.
LocalDesi performs onboarding checks but is not liable for vendor conduct or product performance unless explicitly delivered by LocalDesi staff.

8. Acceptable Use Policy

You agree not to:
Abuse, threaten, or harass any vendor, driver, or staff member,
Use the platform for illegal or fraudulent activities,

• Create multiple accounts to gain unfair advantages or bypass restrictions,
• Upload or share inappropriate or misleading content.
• Circumvent the platform for direct payments or off-platform bookings

We reserve the right to suspend or terminate accounts found in breach of this policy.

9. User Reviews & Content

You may leave reviews, ratings, or upload content on the platform (“User Content”). By doing so, you:

• Grant LocalDesi a non-exclusive, royalty-free, global licence to use/display your content,
• Confirm that your content is truthful, appropriate, and not misleading or defamatory.

We reserve the right to moderate or remove content at our sole discretion.

10. Privacy

We collect personal data in line with the LocalDesi Privacy Policy.

This may include:

• Your name, email, address, and contact details,
• Order history and preferences,
• Device and usage data for improvement of services.

You consent to this use when using our Platform.

11. Limitation of Liability

To the maximum extent permitted by law:

• LocalDesi is not liable for any indirect or consequential loss (including data loss, lost revenue, or reputation damage),
• LocalDesi is not liable for product faults, service quality, vendor or driver conduct, or car rental disputes
• Our total liability is limited to the value of the transaction in question
• Liability is limited to the amount paid by you for the affected transaction.

This does not affect any rights you have under the Australian Consumer Law.

12. Indemnity

You agree to indemnify LocalDesi and its affiliates from any claims, losses, damages, or legal costs resulting from:

• Your misuse of the Platform,
• Your breach of these Terms,
• Any claim related to your User Content or conduct.

13. Termination

We may suspend, restrict, or terminate your access to the Platform if:

• You breach these Terms,
• Engage in abusive or fraudulent behaviour, or
• As required by law or operational necessity.

You may also delete your account at any time via the app or by contacting support.

 

14. Changes to Terms

LocalDesi may update these Terms at any time.

When changes are made, we’ll notify you via email or in-app notification. Continued use of the Platform after changes means you accept the revised Terms.

15. Governing Law

These Terms are governed by the laws of Queensland, Australia.

Any disputes will be resolved in the courts of Brisbane, QLD.

16. Car Rentals

• If you rent a car through LocalDesi, you:
• Must hold a valid Australian or international driver’s license
• Agree to the rental provider’s own rules (e.g., fuel policy, kilometres allowed, bond)
• Are liable for traffic fines, tolls, and any damage caused during the rental
• Never smoke or eat inside a rental vehicle if told by the rental provider, not cause any damage to the vehicle

LocalDesi is not liable for accidents, personal injury, or disputes between car providers and renters.

17. Scope

This Agreement applies to:

• The LocalDesi mobile apps (iOS and Android),
• Our websites
• Social media pages (including but not limited to Instagram, Facebook, TikTok, and YouTube).

All digital content, features, offers, and interactions across these platforms fall under this agreement.

You agree not to:

• Use automation tools (bots/scrapers) on the site or app,
• Post misleading or harmful content on our social pages,
• Impersonate LocalDesi in any form across digital media.

We reserve the right to remove or block users from any of our online channels for violating these Terms or engaging in abuse, spam, or hate speech.

18. Platform Use Disclaimer

LocalDesi is a marketplace platform only. All services and rentals are delivered by independent third-party providers. LocalDesi does not guarantee service quality, safety, or availability, and is not liable for any damages, delays, or disputes arising from provider actions. By using the platform, you agree to our Service Agreement, Terms and conditions, Cookie/content policy and Refund Policy.
